Terms & Conditions – Fortis High Performance Center

Article 1 – Definitions
In these terms and conditions, the following definitions apply:

• Gym: Fortis High Performance Center, located at Barcelonastraat 90, 6135 LN Sittard, registered with the Dutch Chamber of Commerce (KvK) under number 97543330.

• Member: the natural person who enters into an agreement with the gym.

• Agreement: the membership or subscription granting access to the facilities and services of the gym.

Article 2 – Applicability
These terms and conditions apply to all agreements between Fortis High Performance Center and the member.
Deviations are only valid if agreed upon in writing.

Article 3 – Membership and Registration
Membership commences on the date of registration or an agreed start date.
Upon registration, the gym may charge registration and/or administrative fees.
Membership is strictly personal and non-transferable.

Article 4 – Duration, Termination, and Cooling-Off Period
Memberships are entered into for a minimum period of three (3) months.
After this initial period, membership can be terminated monthly.
The notice period is one (1) month and starts from the payment date.
Termination can be submitted via email or in writing at the gym’s reception.
Members who register online or outside the gym have the right to cancel the agreement within 14 days of the first payment (cooling-off period) without providing a reason.
If the member uses the facilities during the cooling-off period, the right of withdrawal lapses once the membership has been fully executed.
Suspension of membership is only possible in cases of long-term illness, injury, or pregnancy, provided this is demonstrated in writing.

Article 5 – Payment
Membership fees are automatically collected monthly on the date of the first payment (the primary payment date).
If collection is not possible, the gym reserves the right to charge administrative and/or collection fees.
The gym reserves the right to adjust rates annually. Members will be notified at least 30 days in advance.

Article 6 – Use of Facilities
Members must comply with the house rules and staff instructions.
Fortis High Performance Center reserves the right to change opening hours, classes, or facilities.
Use of the facilities is at the member’s own risk.

Article 7 – Group Classes and Personal Training
Reservation may be required to participate in group classes or personal training.
Cancellations must be communicated at least 24 hours in advance. Late cancellations may be charged.
The gym reserves the right to cancel or reschedule classes in case of insufficient participants or force majeure.

Article 8 – Liability
The gym is not liable for loss, damage, or theft of members’ property.
The gym is not liable for injury or damage occurring during the use of the facilities, except in cases of intent or gross negligence.
Members are obliged to report health issues that may affect safe participation in advance.

Article 9 – Privacy, Photo and Video Material
The gym processes personal data of members in accordance with the General Data Protection Regulation (GDPR).
Cameras may be present in the gym for safety purposes.
During training and events, Fortis High Performance Center may record photo and video material for promotional purposes. Members who object can notify the gym prior to recording.

Article 10 – Termination by the Gym
The gym may terminate membership immediately in cases of:

• Serious or repeated violation of the house rules;

• Misconduct or dangerous behavior;

• Repeated non-payment.

No refund of fees will be given in the event of termination due to blameworthy behavior.

Article 11 – Amendments
The gym reserves the right to amend these terms and conditions.
Members will be notified at least 30 days prior to the effective date of any changes.

Article 12 – Applicable Law
All agreements are governed by Dutch law.
Disputes arising from the agreement shall be submitted to the competent court in the district where Fortis High Performance Center is located.
